End-User License Agreement

This End-User License Agreement ("EULA") is a legal agreement between you ("Licensee") and Camera Hound ("Licensor") for the Camera Hound software application, including any associated documentation and updates (collectively, the "Software").

By purchasing, downloading, installing, or using the Software, you agree to be bound by the terms of this EULA. If you do not agree, do not install or use the Software.

1. License Grant

Subject to the terms of this EULA, Licensor grants you a limited, non-exclusive, non-transferable, perpetual license to:

  • Install and use one (1) instance of the Software on hardware you own or control (e.g., a Synology NAS, Docker host, or personal server).
  • Use the Software for personal, non-commercial home monitoring purposes.

2. Restrictions

You may not:

  • Redistribute, sublicense, sell, lease, or transfer the Software or your license to any third party.
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Software, except where expressly permitted by applicable law.
  • Remove, alter, or obscure any copyright, trademark, or proprietary notices in the Software.
  • Use the Software to provide services to third parties (e.g., as a hosted or managed service for others).
  • Use the Software for surveillance of persons without their knowledge or consent where required by law.

3. Intellectual Property

The Software is licensed, not sold. Licensor retains all right, title, and interest in and to the Software, including all copyrights, patents, trade secrets, and other intellectual property rights. This EULA does not grant you any rights to trademarks or service marks of Licensor.

4. Third-Party Services

The Software integrates with third-party services including but not limited to Ring (Amazon), Google Nest (Google), and optionally Ollama. Your use of these services is governed by their respective terms of service and privacy policies. Licensor is not responsible for the availability, functionality, or policies of any third-party service.

Nest/Google Device Access requires a separate one-time $5 registration fee paid directly to Google. This fee is not charged by or refundable through Licensor.

5. Data and Privacy

The Software runs entirely on your own hardware. Camera images, face recognition data, detection events, and all other data processed by the Software remain on your device and are never transmitted to Licensor or any third party by the Software itself. You are solely responsible for the security of your installation and the data it processes.

6. Open-Source Components

The Software incorporates open-source libraries (including but not limited to YOLOv8, DeepFace, FastAPI, and OpenCV) which are subject to their own license terms. A list of major open-source components and their licenses is available upon request. Nothing in this EULA restricts your rights under applicable open-source licenses.

7. Updates

Your license includes access to future updates and bug fixes for the Software at no additional charge. Licensor is not obligated to provide updates on any schedule or to maintain backward compatibility with any third-party service.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPATIBLE WITH ALL HARDWARE OR THIRD-PARTY SERVICES.

Face recognition accuracy depends on camera angle, lighting, image quality, and other factors. Licensor makes no guarantee regarding detection or recognition accuracy.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

LICENSOR'S TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE LICENSE.

10. Termination

This EULA is effective until terminated. Your license terminates automatically if you fail to comply with any term of this EULA. Upon termination, you must cease all use of the Software and destroy all copies in your possession.

11. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-law provisions.

12. Entire Agreement

This EULA constitutes the entire agreement between you and Licensor regarding the Software and supersedes all prior agreements or understandings.
